These Terms govern your use of frenlybricks.store and purchases from Frenly Bricks Store, the registered business operating the Frenly Bricks brand under ABN 48 238 162 094 ("Frenly Bricks", "we", "us" or "our"). The legal contracting party is the sole trader identified in that official ABN record. Our Privacy Policy, Shipping Policy and Refund Policy form part of these Terms.

Nothing in these Terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law.

Eligibility and accounts

You must be able to enter a binding contract or use the store with the involvement of a parent or guardian. You are responsible for accurate account and order information, protecting login credentials and activity performed through your account. Tell us promptly if you suspect unauthorised access.

We may suspend an account where reasonably necessary to protect customers, investigate suspected fraud, comply with law or prevent misuse. We will act proportionately and provide reasons where reasonably possible.

Product information and condition

We take reasonable care with descriptions, images, prices, availability, edition, condition and authenticity. Collectibles can have manufacturing variations, shelf wear or packaging differences. Product-specific condition notes and actual-item photographs form part of the description.

Screen colours and image scale can vary. If a product is materially different from its description, your rights under the Australian Consumer Law apply.

Orders, prices and payment

Prices are in Australian dollars unless clearly stated otherwise. Taxes, shipping and any applicable international duties are shown or explained before purchase where reasonably possible. International customers are responsible for import charges imposed by their country unless we expressly agree otherwise.

An order is an offer to buy. We may accept it by confirming or fulfilling the order. We may cancel before fulfilment where stock is unavailable, there is an obvious genuine pricing or description error, payment fails, fraud is reasonably suspected, or fulfilment would be unlawful. If we cancel after payment, we will refund the affected amount promptly.

We will not cancel merely because we later regret an accurately advertised price.

Shipping, pickup and risk

Current rates, destinations, dispatch targets and estimated delivery windows are in our Shipping Policy. A dispatch or delivery time is an estimate unless we expressly guarantee it. Risk in goods passes as provided by law and does not limit rights for loss, damage or non-delivery caused by us or our delivery arrangements.

For pickup, bring the order confirmation and reasonable identity evidence if requested. Another person may collect only where we can reasonably verify authority.

Returns, refunds and consumer guarantees

Our Refund Policy explains the process for change-of-mind returns and remedies. Australian Consumer Law rights apply where goods are faulty, unsafe, not of acceptable quality, do not match description or sample, or fail to do what was represented.

Depending on the problem, you may be entitled to repair, replacement, refund or compensation for reasonably foreseeable loss. We do not require original packaging as a condition of a statutory remedy where that would unlawfully restrict your rights. Proof of purchase can include any reasonable evidence of the transaction.

Pre-orders

Estimated arrival dates can change for reasons outside our reasonable control. We will communicate material delays. You may cancel a delayed pre-order and receive a refund unless a lawful, clearly disclosed exception applies to a specifically ordered or customised item. Statutory rights are unaffected.

Selling and consigning goods to us

Any purchase or consignment arrangement is subject to separate written terms provided before we accept the goods. You must have authority to sell or consign them and disclose known authenticity, ownership and condition issues. We may request reasonable identity and ownership evidence, decline goods, or cooperate with lawful investigations.

The payout, commission, insurance, loss, damage, withdrawal, storage, unsold-item and dispute rules must be recorded in the separate agreement. General website wording does not replace that agreement.

Promotions, giveaways and live auctions

Each promotion, giveaway or auction may have additional terms covering eligibility, dates, platform rules, winner selection, delivery, publicity and cancellation. Those terms will be available before entry or bidding. Value, rarity and savings claims must be read with the item description and are not investment advice.

Live-auction purchases may also be governed by the marketplace's terms. If marketplace terms conflict with rights that cannot be excluded under Australian law, those rights prevail.

Reviews, submissions and acceptable use

If you submit a review, image, comment or other content, you confirm you have the right to do so. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it for operating and promoting Frenly Bricks, subject to our Privacy Policy and any consent required for personal images.

Do not submit unlawful, defamatory, misleading, infringing, malicious or privacy-invasive content. We may moderate or remove content reasonably and transparently, but we do not promise to publish every submission.

You must not interfere with store security, scrape personal information, introduce malicious code, impersonate another person, make fraudulent purchases or use the service unlawfully.

Intellectual property

Our branding, original copy, design and original media are owned by or licensed to us. Product names, characters, logos and third-party material remain the property of their respective owners. Selling genuine branded goods does not imply sponsorship or endorsement.

You may use the site for personal shopping and ordinary linking. Other copying, commercial reuse or distribution requires permission unless allowed by law.

Third-party services and links

The store uses third-party services for commerce, payments, delivery, reviews, loyalty, marketing, marketplaces and support. Their own terms can apply when you choose or access those services. We are not responsible for an unrelated third party's independent conduct, but this clause does not exclude responsibility that the law places on us.

Liability

To the maximum extent permitted by law, we are not liable for loss caused solely by events outside our reasonable control, your unlawful misuse, or information you knew was inaccurate and failed to correct.

Where a guarantee can lawfully be limited and the goods or services are not ordinarily acquired for personal, domestic or household use, our liability may be limited, at our option, to the remedies permitted by section 64A of the Australian Consumer Law.

We do not exclude liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of a non-excludable consumer guarantee, or any other liability that cannot lawfully be excluded.

Changes and availability

We may change store features or these Terms for legitimate business, security or legal reasons. Changes apply prospectively from the stated effective date. We will give reasonable notice of a material change where required and will not use a change to remove an accrued right or avoid an existing obligation.

We may temporarily restrict access for maintenance, security or events outside reasonable control. We will take reasonable steps to restore service.

Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Courts and tribunals with jurisdiction under applicable law may hear disputes. This clause does not prevent a consumer from relying on a mandatory right to bring a claim elsewhere.

Before formal proceedings, please contact frenlybricks.store@gmail.com so we can try to resolve the issue promptly. You may also contact the Australian Competition and Consumer Commission, the Office of Fair Trading Queensland, the Office of the Australian Information Commissioner or another appropriate regulator. This does not limit your right to seek a remedy.
